Terms of Use
Last updated: 22 May 2026
These Terms of Use (“Terms”) govern your use of the Mochi mobile app and this website (the “Service”), operated by [Your Company / Legal Entity Name] (“Mochi”, “we”, “us”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least [13 / the minimum age in your region] years old, and able to form a binding contract, to use the Service. If you use it on behalf of an organisation, you represent that you are authorised to accept these Terms for it.
2. Your account
You are responsible for the activity under your account and for keeping your login credentials secure. Provide accurate information and let us know promptly of any unauthorised use.
3. Subscriptions, trials, and billing
- Mochi offers a free tier and an optional paid subscription (“Pro”), billed monthly or annually.
- A free trial, where offered, automatically converts to a paid subscription unless cancelled before the trial ends.
- Subscriptions auto-renew until cancelled. Manage or cancel renewal in your Apple App Store or Google Play account settings.
- The Service uses in-app consumables (“energy”) and premium credits that refresh while a subscription is active; unused credits stop refreshing if a subscription is cancelled.
- Except where required by law or store policy, payments are non-refundable. Billing, refunds, and price changes are handled under the rules of the app store you purchased through.
4. Acceptable use
You agree not to:
- break the law or infringe others’ rights when using the Service;
- reverse engineer, scrape, or attempt to disrupt or gain unauthorised access to the Service;
- misuse the AI features to generate harmful, abusive, or unlawful content;
- resell, sublicense, or commercially exploit the Service without our permission.
5. Learning content and AI
Mochi generates lessons, essays, and feedback using automated and AI systems. This content is for language-learning purposes only, may contain errors or inaccuracies, and is not professional, educational accreditation, or other expert advice. Always use your own judgement.
6. Intellectual property
The Service, including its software, design, mascot, and branding, is owned by Mochi and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own learning. Content you submit (such as your written sentences) remains yours; you grant us a licence to process it as needed to operate and improve the Service.
7. Third-party services
The Service relies on third parties (including Apple, Google, Anthropic, Microsoft Azure, PostHog, and Sentry). Your use of those features may also be subject to their terms, and we are not responsible for third-party services.
8. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or that the Service will be uninterrupted or error-free, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, Mochi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. [Adjust to your jurisdiction.]
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.
11. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of [Jurisdiction — e.g. England & Wales], without regard to conflict-of-law rules. Disputes will be subject to the courts of that jurisdiction. [Adjust as advised.]
